CONSUMER TERMS AND CONDITIONS

To protect your own interests please read the conditions below carefully before ordering from us and signing the contract overleaf.  We want you to know that you will get a fair deal from us, and to understand exactly what we are both agreeing to in entering this contract.  If you are uncertain as to your rights under these conditions, or want any explanation about them, please contact us at the address above.  You should also take your own legal advice on them, should you wish.


The conditions below apply exclusively to the contract between us and you:

 

1    DEFINITIONS

In this agreement, the following words and phrases have the following special meanings:

“Courtesy Meeting”  
means a home courtesy visit by us after the work is completed to the Property to examine the work carried out by the Installer and to check if you are happy with the work;

“Design Meeting”      
means a visit by us to the Property to discuss options with you and to produce designs and Plans;

 “Final Quote”             
means the final Plans and Prices for all the Installation Works and Goods which will be given to you at or after the Design Meeting;

“Goods”                      
  means any goods specified overleaf that we will supply to you;

“Installation Works”  
means the work required to fit the Goods into the Property as set out in the Plans;

“Installer”                    
means the specialist bathroom fitting company that we use to carry out the Installation Works and fit the Goods into your Property;

“Plans”                        
mean the plans for the bathroom layout and design produced by us for you, and agreed with you, at the Design Meeting;

“Price”                          
means the price for the Goods specified overleaf plus the Price for the Installation Works set out in the Final Quote (both including VAT);

“Second Survey”      
means a possible home visit by the Installer to the Property to examine the room into which the Goods are to be fitted;

“Us/We”                      
means Premier Living Limited trading as the Premier Living of Suite 19, Durham & Tees Valley Business Park, Orde Wingate Way, Stockton-on-Tees, Middlesbrough TS19 0GD;

“You”
                           
means you, the customer, whose details are set out overleaf;

 

2    WHAT WILL YOU GET

2.1    You contact us as a result of our publicity or via our website and ask for a visit at the Property.  We will send you our catalogue in advance of the visit so that you can consider our range of Goods.

2.2    We come to the Property for a Design Meeting, discuss design ideas and product ranges with you, and produce some preliminary drawings and ideas.  If you want to take things further, when you have chosen the Goods you require, we will carry out a survey of the relevant room, to measure up and produce a final set of Plans for you to consider and agree.

2.3    Sometimes, depending on the complexity of the designs and proposed Installation Works, we may need to ask the Installer to carry out a Second Survey of your Property on a later date, to be agreed with you.

2.4    We will then give you a Final Quote and agree with you the final version of the Plans. It is your responsibility to check the final Plans (including the measurements). If you are happy with the Final Quote, the Price, and the Plans produced, and want to go ahead with buying the Goods and having the Installation Works carried out, you will sign the contract overleaf, and pay us the deposit set out in condition 3.1.

2.5    Because you are signing the contract in your home, you have a statutory right to cancel the contract within 7 days of signing the contract.  Details of your rights are set out in condition 4 below.

2.6    If you do not cancel the agreement and proceed with your bathroom refit, we will then send you either by email, on cd, or on paper through the post, a copy of the final Plans.   We do not release these until after the cancellation period has expired, as otherwise we could be giving you our design work for free.

2.7    Please note that as goods are being ordered to your personal specification, you cannot make changes to the Plans once Installation Works have started.  However, if you want to make minor changes to the Plans within 14 days of accepting the Final Quote, sometimes we may be able to accommodate a change if the Goods to be changed are not already on order, or if the effect to the Installation Works is minor.  If those changes increase or decrease the costs of the Goods or of the Installation Work, we will need to agree with you an alteration to the Price, and if you are not happy with the proposed change in Price, you can revert back to the original Plans.

2.8    We will then send a copy of the finalised Plans to the Installer, and will contact you to inform you of the final timescale and arrange a mutually convenient delivery date to carry out the Installation Works.  We will liaise with you and the Installer to arrange for delivery of the Goods at a suitable time. 

2.9    We will do our best to make sure that delivery dates are achieved, but rarely delays may occur where the Goods are held up in transit or through other problems we could not have reasonably anticipated or avoided (some examples of when this might happen include strikes, fuel shortages, inclement or extreme weather).

2.10    You are responsible for checking that you have a suitable source of supply for any gas or electrical appliances that you or we are supplying¸ and suitable general services within the Property.  This is because we have no control over your sources of energy supply to, or within, the Property, or over water and waste services to and from the property.  This means that you should make sure that existing wiring, gas, water and waste pipework within the Property is generally of a legal and suitable standard.

2.11    You are responsible for checking that any appliance, accessory or component supplied by yourself is suitable for use with the Goods (For example, if you decided to retain your own taps or shower unit, you would need to make sure they are compatible with your new bathroom suite).

2.12    For the health and safety of our team and of the Installer, you are responsible for removing all of the contents from the room where the Installation Works are to be carried out, and for cleaning it, before the arrival of the Installer to start the Installation Works.  The Installer may reasonably refuse to start work where this has not been done, and you will be responsible for any delays which arise as a result.

2.13    You are also responsible for giving the Installer reasonable access to the Property and to the relevant areas of the Property needed to complete the Installation Works – if the team cannot get into the Property or relevant rooms, it will be impossible for them to be able to do the work as quickly as all had hoped.  

2.14    Please note there may be pattern, shade and grain variations in Goods made from natural materials, such as marble or timber.  There may also be some variations in pattern, shade and texture between natural and composite materials used in Goods where you have ordered such a combination.

2.15    Once the Installation Works are finished, you are responsible for inspecting the Installation Works and signing them off with the Installer.  If you have any problems at this stage, please contact us.  We are keen that you are happy that the Installation Works have been completed to a suitable professional standard, and we want to know about any issues or problems that you have. Where there are any genuine issues with either the Goods or the Installation Works we will take steps to try and resolve those issues with you to your satisfaction as soon as possible.

2.16    After the Installation Works are complete, we will attend a Courtesy Meeting with you at the Property to check that all has gone well.  

 

3    PRICE AND PAYMENT

3.1    A deposit of 25 per cent of the Price is due from you when you sign the contract overleaf which is to cover the cost of drawing up the Plans. It is only refundable to the extent set out in condition 4 below.

3.2    A second payment of 65 per cent of the Price is due from you before the Installation Works are carried out.  We will invoice you when we agree the date for the Installation Works with you, and you must pay the invoice within 21 days of issue or by the day before the Installation Works, whichever is sooner. 

3.3    A final payment of 10 percent of the Price is due from you within 7 days of the Courtesy Meeting.

3.4    You must pay the deposit and the second payment on time – if you do not, we may not order the Goods from the Manufacturer or may not confirm their delivery to the Property until payment has been received in full (and alternatively may cancel the contract).

 

4    CANCELLATION

4.1    Where you cancel this contract by letting us know in writing at our address within 7 days of signature that you no longer want to go ahead, we will refund your deposit to you, if you return any copies of the Plans in your possession to us.  We would suggest that you send any cancellation letter by recorded delivery to make sure that it arrives with us, and on time.

4.2    Where you exercise any other statutory rights, we will abide by the law and follow its requirements.

 

5    IF THERE IS A PROBLEM WE CANNOT RESOLVE

5.1    This contract is under English law and any disputes will be dealt with by the English Courts.

5.2    If any words or phrases in this contract are in any particular circumstances held by a Court to be unfair, unreasonable or invalid, we agree that the Court can delete those words or phrases from this Agreement, and read the Agreement as if they had not been included in the first place.
